Pursuant to the Electronic Signatures in Global and National Commerce Act (“ESIGN Act”) the following ESIGN Act Disclosure and Consent explains how the registration process will be conducted electronically by Accurate Public Records. After reviewing this Disclosure and Consent you can agree to proceed electronically by clicking the “I consent” check box and typing your full name in the "Signature" text field below. As part of the credentialing process at Accurate Public Records, we are required by law to obtain certain certifications from our end users. You (the end user) are agreeing to receiving and signing these certifications electronically. By typing your name, you are consenting to receive any communications (legally required or otherwise) and all changes to such communications electronically until your consent is withdrawn. In order to use the website, you must provide at your own expense an internet-connected device that is compatible with the minimum requirements outlined below. You also confirm that your device will meet these specifications and requirements and will permit you to access and retain the communications electronically each time you access and use the website.

To receive and view an electronic copy of the Communications you must have the following equipment and software:

• A personal computer or another device that is capable of accessing the Internet. Your access to this page verifies that your system/device meets these requirements.
• An Internet web browser that is capable of supporting 128-bit SSL encrypted communications, JavaScript, and cookies. Your system or device must have 128-bit SSL encryption software. Your access to this page verifies that your browser and encryption software/device meet these requirements.

To retain a copy, you must either have a printer connected to your personal computer or other device or, alternatively, the ability to save a copy through the use of printing service or software such as Adobe Acrobat®. You can also contact us to withdraw your consent to receive any future communications electronically, including if the system requirements described above change and you no longer possess the required system. If you withdraw your consent, we will terminate your use of the Accurate Public Records website and the services provided through the Accurate Public Records website.

To ensure that a signature is unique and to safeguard you against unauthorized use of your name, your IP address (3.145.155.149) has been recorded and will be stored along with your electronic signature. All of your information will be encrypted and transmitted via our secure website.

I understand that Accurate Public Records uses computer technology to ensure that my signed documents are not altered after submission. I agree to allow Accurate Public Records to validate my signed documents in this way.

END USER CERTIFICATIONS OF USE
FOR EMPLOYMENT INSIGHT REPORTS

In compliance with the Federal Fair Credit Reporting Act as amended by the Consumer Credit Reporting Reform Act of 1996 (the “Act”), you (“End User”) hereby certifies to Accurate Public Records, LLC ("Consumer Reporting Agency") that you will comply with the following provisions:

1. End User will ensure that prior to procurement or causing the procurement of a consumer report for employment purposes (an Employment Insight Report):
1. a clear and conspicuous disclosure has been made in writing to the consumer at any time before the report is procured or caused to be procured, in a document that consists solely of the disclosure, that a consumer report may be obtained for employment purposes; and
2. the consumer has authorized in writing the procurement of the report by the End User.
2. In using a consumer report for employment purposes, before taking any adverse action based in whole or in part on the report, the End User shall provide to the consumer to whom the report relates
1. a copy of the report; and
2. a description in writing of the rights of the consumer under the Act, a copy of which is attached hereto (“Summary of Consumer Rights”).
   The information from the consumer report will not be used in violation of any applicable federal or state equal employment opportunity law or regulation.

FCRA REQUIREMENTS

Federal Fair Credit Reporting Act (as amended by the Consumer Credit Reporting Reform Act of 1996)

Although the FCRA primarily regulates the operations of consumer credit reporting agencies, it also affects you as a user of information. We suggest you download a copy of the FCRA and that you and your employees become familiar with the following sections in particular:

Each of these sections is of direct consequence to users who obtain reports on consumers.

As directed by the law, credit reports may be issued only if they are to be used for extending credit, review or collection of an account, employment purposes, underwriting insurance, or in connection with some other legitimate business transaction such as in investment, partnership, etc. It is imperative that you identify each request for a report to be used for employment purposes when such a report is ordered. Additional state laws may also impact your usage of reports for employment purposes.

We strongly endorse the letter and spirit of the Federal Fair Credit Reporting Act. We believe that this law and similar state laws recognize and preserve the delicate balance between the rights of the consumer and the legitimate needs of commerce.

In addition to the Federal Fair Credit Reporting Act, other federal and state laws addressing such topics as computer crime and unauthorized access to protected databases have also been enacted. As a prospective user of consumer reports, we expect that you and your staff will comply with all relevant federal statutes and the statutes and regulations of the states in which you operate.

We support consumer reporting legislation that will assure fair and equitable treatment for all consumers and users of credit information.

ACCESS SECURITY REQUIREMENTS

We must work together to protect the privacy of consumers. The following measures are designed to reduce unauthorized access of consumer credit reports. In accessing consumer credit services, you agree to follow these measures.

1. You must protect your account number and password so that only key personnel employed by your company know this sensitive information. Unauthorized persons should never have knowledge of your password. Do not post this information in any manner within your facility. If a person who knows the password leaves your company or no longer needs to have it due to a change in duties, the password should be changed immediately.
2. System access software, whether developed by your company or purchased from a third party vendor, must have your account number and password “hidden” or embedded and be known only by supervisory personnel. Assign each user of your system access software a unique logon password. If such system access software is replaced by different access software and therefore no longer in use or, alternatively, the hardware upon which such system access software resides is no longer being used or is being disposed of, your password should be changed immediately.
3. Do not discuss your account number and password by telephone with any unknown caller, even if the caller claims to be an employee of your credit provider.
4. Restrict the ability to obtain credit information to a few key personnel.
5. Place all terminal devices used to obtain credit information in a secure location within your facility. You should secure these devices so that unauthorized persons cannot easily access them.
6. After normal business hours, be sure to turn off and lock all devices or systems used to obtain credit information.
7. Secure hard copies and electronic files of consumer reports within your facility so that unauthorized persons cannot easily access them.
8. Shred or destroy all hard copy consumer reports when no longer needed.
9. Erase and overwrite or scramble electronic files containing consumer information when no longer needed and when applicable regulation(s) permit destruction.
10. Make all employees aware that your company can access credit information only for the permissible purposes listed in the Permissible Purpose Information section of your registration. You or your employees may not access their own reports. Nor should you or your employees access the report of a family member or friend unless it is in connection with a credit transaction or for some other permissible purpose.

Record Retention: The Federal Equal Opportunities Act states that a creditor must preserve all written or recorded information connected with an application for 25 months. In keeping with the ECOA, Accurate Public Records requires that you retain the credit application and, if applicable, a purchase agreement for a period of not less than 25 months. When conducting an investigation, particularly following a consumer complaint that your company impermissibly accessed their credit report, Accurate Public Records will contact you and will request a copy of the original application signed by the consumer or, if applicable, a copy of the sales contract. “Under Section 621 (a) (2) (A) of the FCRA, any person that violates any of the provisions of the FCRA may be liable for a civil penalty of not more than $2,500 per violation.”

THE FOLLOWING APPLIES TO CONSUMER CREDIT REPORTS

I have read and understand the “FCRA Requirements” notice and “Access Security Requirements” and will take all reasonable measures to enforce them within my facility.

I certify that I will use the consumer credit report information for no other purpose other than what is stated in the Permissible Purpose / Appropriate Use section on this application and for the type of business listed on this application.

I will not resell the report to any third party.

I understand that if my system is used improperly by company personnel, or if my access codes are made available to any unauthorized personnel due to carelessness on the part of any employee of my company, I may be held responsible for financial losses, fees, or monetary charges that may be incurred and that my access privilege may be terminated.
